Commissioners Are Breaking The Law

The City Commissioners are breaking the Kansas Open Meetings Act. The Commissioners are talking on the telephone and e-mailing each other on City business.

Decisions are being made.

It is called a "Calling Tree" is Commissioners use the phone or e-mail to contact three or more members.

Kansas Attorney General Carla J. Stovall stated in Attorney General Opinion No. 98-26: "In summary, a series of meetings each of which involves less than a majority of a quorum of a public body, but collectively totaling a majority of a quorum, at which there is a common topic of discussion of the business or affairs of that body constitutes a meeting for purposes of the KOMA."
 

Several members of the Commission have been told that what they are doing is wrong and copies of the Attorney General’s Opinion have been given to the Commissioners.
